- Tex. Crim. App.
- Keller, P.J.
The habeas applicant claims that an expert's testimony was inadmissible under Texas Rule of Evidence 702 under the holding of Coble
, and he contends that this testimony violated the heightened reliability requirement of the Eighth Amendment. The holding in Coble
does not give rise to a claim that is cognizable on habeas corpus. Coble
also forecloses the applicant's Eighth Amendment claim. Relief is denied. Court of Criminal Appeals, No. AP-76,533, 11-07-2012.
