The appellants assert that the trial court erred when it granted the appellees' motion for summary judgment because the appropriate cause of action was one in trespass to try title. The appellants also assert that they proved their right to reformation as a matter of law. Generally, non-possessory interests are not proper subjects of a trespass-to-try-title action. The appellants did not conclusively prove that the appellees were not bona fide purchasers. The trial court's judgment is affirmed in part, and reversed and remanded in part. Eastland Court of Appeals, No. 11-11-00128-CV, 11-30-2012.
