Brannan v. State
Because the vegetation line shifted due to storms, the Village of Surfside Beach refused to allow houses to be repaired or to have access to utilities, and the state asserted that the houses encroach on a public access easement and must be removed. The court of appeals rejected the petitioners' claims that the refusal constituted a taking. In light of Severance, the court of appeals' judgment is vacated and remanded.
