• Tex. App. Dist. 14
  • Kem Thompson Frost Justice
The relator seeks a writ of mandamus ordering the trial judge to vacate his order disqualifying the Harris County District Attorney's office from representing the State of Texas in three causes. A district attorney who is not legally disqualified may request that the district court permit him to recuse himself in a particular case for good cause; the trial court cannot require his recusal. The writ is conditionally granted. Houston's 14th Court of Appeals, No. 14-12-00975-CR, 01-29-2013.
